Terms of Use

Welcome to Pro Compass ("the App", "we", "us", or "our"), an application published by Shenzhen Caractiv Tech Company Limited ("Caractiv Tech"). These Terms of Use ("Terms") govern your access to and use of the App and any related services. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Use of the App

Pro Compass is a navigation and measurement utility that provides a compass, an altimeter, a bubble level, a weather map, and a GPS watermark camera. We grant you a personal, limited, non-exclusive, non-transferable, and revocable license to use the App for your own lawful purposes, in accordance with these Terms. You agree not to misuse the App, interfere with its operation, attempt to access it through unauthorized means, or use it in any way that violates applicable laws.

2. Not a Safety-Critical Instrument

The compass heading, geographic coordinates, altitude, level, and weather information provided by the App are derived from your device's sensors and from third-party data providers, and are offered for general reference and informational purposes only. Readings can be affected by magnetic interference, sensor calibration, atmospheric conditions, GPS signal quality, and data-provider accuracy. You must not rely on the App for navigation, aviation, marine, mountaineering, emergency, or any other situation where inaccurate information could lead to injury, death, or property damage. Always use professional, certified equipment for safety-critical activities.

3. Your Content and Device Permissions

You are responsible for any photos or other content you create or store using the App, and for keeping your device secure. You retain ownership of your own content. Certain features request access to your device's location, camera, photo library, and motion/barometer sensors; these are used only to provide the related feature, as described in our Privacy Policy. You may manage these permissions at any time in your device settings.

4. Acceptable Use

You agree not to use the App to:

break any applicable law or regulation;
infringe the intellectual property or other rights of any person;
create or distribute harmful, fraudulent, offensive, or unlawful content;
attempt to reverse engineer, copy, or resell the App without permission;
disrupt, damage, or gain unauthorized access to the App or its systems.

5. Intellectual Property

The App, including its design, features, text, graphics, logos, and software, is owned by us or our licensors and is protected by intellectual property laws. Map and weather data are provided by third-party services and remain the property of their respective owners. Except for the content you provide, nothing in these Terms transfers any ownership rights to you.

6. Purchases, Subscriptions, and Lifetime Access

The App offers optional paid features. Access to the App's premium features may require a paid plan. The available plans are:

a weekly auto-renewable subscription (which may begin with an introductory first-period price);
a yearly auto-renewable subscription;
a lifetime one-time purchase, which is not a subscription and does not auto-renew.

The exact title, length, and price of each plan are shown on the purchase screen inside the App at the time of purchase, in your local currency. The following terms apply to all auto-renewable subscriptions purchased through the Apple App Store or Google Play:

Payment will be charged to your Apple ID or Google Play account upon confirmation of purchase.
The subscription automatically renews unless it is cancelled at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price of the selected plan.
You can manage your subscriptions and turn off auto-renewal at any time in your App Store or Google Play account settings after purchase.
Where an introductory or free offer is provided, any unused portion is forfeited when you purchase the standard subscription, where applicable.

Subscriptions are managed through RevenueCat on our behalf, and billing, renewals, and refunds are handled by the applicable app store and are subject to that store's terms. Prices and available features may change; any changes will apply only on a going-forward basis.

7. Apple App Store and End User License Agreement (EULA)

If you download the App from the Apple App Store, your license to use the App is also governed by Apple's standard Licensed Application End User License Agreement (EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These Terms are intended to supplement, and where consistent are incorporated into, that EULA. In the event of a conflict between these Terms and Apple's EULA with respect to your use of the App on Apple devices, Apple's EULA shall govern to the extent of the conflict. In particular, you acknowledge and agree that:

No Apple responsibility: These Terms are concluded between you and us only, and not with Apple. Apple is not responsible for the App or its content.
Scope of license: The license granted to you for the App is a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions.
Maintenance and support: We, not Apple, are solely responsible for providing any maintenance and support services for the App. Apple has no obligation to furnish any maintenance or support services.
Warranty: We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Product claims: We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of it, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims under consumer protection, privacy, or similar legislation.
Intellectual property: In the event of any third-party claim that the App or your use of it infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
Legal compliance: You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-party terms: You must comply with applicable third-party terms of agreement when using the App.
Third-party beneficiary: You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

8. Third-Party Services

The App relies on third-party services to provide its features, including weather and map data providers (such as WeatherAPI.com, OpenWeatherMap, QWeather, Open-Meteo, RainViewer, MapTiler, OpenStreetMap, and Amap), subscription management (RevenueCat), the Apple App Store and Google Play, and, where enabled, attribution and analytics providers (AppsFlyer and Meta). We do not control these services and are not responsible for their availability, accuracy, or practices, and your use of them is subject to their terms.

9. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, secure, or that any reading, measurement, or output will be accurate or meet your expectations. You use the App at your own discretion and risk.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of (or inability to use) the App, including any reliance on its readings or data. Our total liability for any claim shall not exceed the amount you paid, if any, to use the App.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your content, or your violation of these Terms.

12. Suspension and Termination

We may suspend, restrict, or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or to protect the App or its users. You may stop using the App at any time by uninstalling it.

13. Changes to the App and Terms

We may modify, update, or discontinue the App or any of its features at any time. We may also update these Terms from time to time. Changes take effect when posted, and the "Last updated" date will be revised. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the applicable laws of the jurisdiction in which our company is registered, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.
